HARTSFIELD-JACKSON ATLANTA INTERNATIONAL AIRPORT

WI-FI SYSTEM –USER AGREEMENT AND ACCEPTABLE USE POLICY

Please read the following information carefully before using this service. You may not use the service without accepting the Wi-Fi System User Agreement and Acceptable Use Policy.

Welcome to the Free Wireless High-Speed Internet Access System (“Wi-Fi System” or “Service”)) at the City of Atlanta’s (“City”) Hartsfield-Jackson Atlanta International Airport (“ATL”). This Wi-Fi System User Agreement and Acceptable Use Policy (“Agreement”) governs your rights and responsibilities and our rights and responsibilities relating to the use of the Wi-Fi System.

 

Acceptance of the Wi-Fi System User Agreement and Acceptable Use Policy

BY CLICKING ON “I AGREE WITH THE WI-FI SYSTEM USER AGREEMENT ANDACCEPTABLE USE POLICY” ON THE WI-FI SYSTEM SPLASH PAGE, YOU REPRESENT THAT:

YOU HAVE READ, UNDERSTAND AND AGREE TO THE TERMS OF THIS AGREEMENT; AND

YOU ARE AT LEAST 18 YEARS OF AGE.

If you do not agree to the terms of this Agreement, you may not use the Wi-Fi System. Your electronic acceptance of this Agreement by clicking “I Agree with the Wi-Fi System User Agreement andAcceptable Use Policy” has the same effect as if you had actually signed this Agreement. The effective date of this Agreement is the date that you click on “I Agree with the WiFi System User Agreement andAcceptable Use Policy.”

 

Description of Wi-Fi System/Service Availability

ATL will provide free access to the Wi-Fi System at locations that have been equipped with wireless access points (“Enabled Locations”). Enabled Locations may not be available in all areas of ATL and may not always be operational. Use of the Service will require a compatible Wi-Fi-enabled device.

ATL will provide you with limited wireless card configuration support and connection assistance support services by calling 877-HJA-WiFi (877-452-9394).

 

Logging Out

You will be automatically logged out if there is inactivity on your computer for 60 minutes.

 

Access to Internet Content

The City does not control, nor is the City responsible or liable for data, content, services, or products (including software) that you access, download, receive or buy via the Service. The City may blockaccess to certain services, products or domains to protect the City, the City’s network, the public or other users of the Service. The Internet contains materials which may be offensive to you. The City is not a publisher of third-party content accessed through the Service, and is not responsible for the content, accuracy, timeliness or delivery of any opinions, advice, statements, messages, services, graphics, data or any other information provided to or by third parties as accessible through the Service. You are responsible for paying all fees and charges of third party vendors whose sites, products or services you access, buy or use via the Service. If you choose to use the Service to access websites, services or content, or purchase products from third parties, and make your personal information may be available to the third-party provider, how third parties handle and use your personal information related to their sites and services is governed by their privacy and other policies (if any) and not the City’s. The City has no responsibility for third party provider policies, or their compliance with them. You are liable for any and all liability that may arise out of the content transmitted by or to you using the Service. Your use of the Service and content shall at all times comply with all applicable laws and regulations. The City reserves the right to terminate or suspend your Service if the City determines that your use does not conform with the requirements set forth in this Agreement, or interferes with the City’s ability to provide Service to you or others, or receives notice from anyone that your use may violate any laws or regulations. The City’s actions or inaction under this Section shall not constitute review or approval of your use.

 

Your Responsibilities

You must (1) provide all equipment (including computer hardware and software, personal digital assistances, wireless network cards, etc.) to connect to the Wi-Fi System, (2) comply with this Agreement; (3) comply with the Acceptable Use Policy of AT&T which is available at this link:www.att.com/aup; and (4) comply with local, state, federal and international laws and regulations, including but not limited to copyright and intellectual property rights laws. You agree to be responsible for and to bear all risk and consequences for (1) the accuracy, completeness, reliability and/or usefulness of any content you may access through the Wi-Fi System and (2) all communications that you send or receive via the Wi-Fi System. ATL does not promise any security or privacy protection when you use the Service. It is your sole responsibility to install and deploy technological tools to protect your any data, communications and equipment that may be compromised by use of a unsecured wireless network.

 

Acceptable Use Policy

All users of the Wi-Fi System must comply with this Acceptable Use Policy (“AUP”). This AUP is intended to prevent unacceptable uses of the Internet. ATL does not actively monitor the use of the Wi-Fi System under normal circumstances. Similarly, ATL does not exercise editorial control or review the content of any website, electronic mail transmission, newsgroup or other material created or accessible over or through the Wi-Fi System. However, ATL may remove, block, filter or restrict by any other means access to any materials that, in ATL’s sole discretion, may be illegal, may subject ATL to liability or may violate this AUP. ATL may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong committed through use of the Service. Violation of this AUP may result in the suspension or termination of either access to the Wi-Fi System or other actions as detailed below.

The following constitutes examples of violations of this AUP. You agree NOT to use the Wi-Fi System to:

Transmit any material (by uploading, posting, email or otherwise) which violates United States, state or local laws, including but not limited to criminally threatening, obscene or harassing materials;

Forge headers or otherwise manipulate identifiers in order to disguise the origin or any material transmitted through the Wi-Fi System;

Transmit any material (by uploading, posting, email or otherwise) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any third party;

Transmit (by uploading, posting, email or otherwise) any unsolicited or unauthorized advertising;

Transmit any material (by uploading, posting, email or otherwise) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

Disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other user’s ability to engage in real time exchanges;

Interfere with or disrupt the Wi-Fi System or servers or networks connected to the Wi-Fi System, or disobey any requirement, procedures, policies or regulation of networks connected to the Wi-Fi System;

 

“Stalk” or otherwise harass another; or collect or store, or attempt to collect or store, personal data about third parties without their knowledge or consent;

Resell the Wi-Fi System;

Use the Wi-Fi System for high volume data transfers, hosting a web server, IRC server, or any other server.

 

Termination

You agree that ATL may terminate this Agreement and cancel your access to the Wi-Fi System without notice and for any reason including, but not limited to violation of any of the terms and conditions of this Agreement, security or safety reasons, using the Wi-Fi System to perform any illegal activity and/or in appropriate circumstances if you are determined to be a repeat copyright infringer. You further agree that in the event of termination for any reason ATL will have no liability to you.

 

Notice of Problems or Complaints

If you experience a problem accessing or using the Wi-Fi System, report the problem by calling 877-HJA-WiFi (877-452-9434).

 

ATL requests that anyone who believes that there is a violation of this Agreement or the AUP specifically direct the complaint to: NOCOperators@atlanta-airport.com. If available, please provide the following information: (1) the IP address used to commit the alleged violation; (2) the date and time of the alleged violation, including the time zone; (3) evidence of the alleged violation; and (4) your contact information including full name, email address and telephone number. When reporting an issue regarding unsolicited email please provide a copy of the email messages with full headers which typically provides all of the above data. Other situations will require different methods of providing the necessary information.

 

Modifications

ATL may, at its sole discretion, modify the terms and conditions of this Agreement, including the AUP, at any time. Such modifications shall be binding and effective upon posting on the Wi-Fi System “Access Sign Up” page. You agree to periodically review the Wi-Fi System “Access Sign Up” page to maintain awareness of any modifications. By continuing to use the Wi-Fi System after such postings, you accept and agree to any and all such modifications.

 

Indemnification

You shall defend, indemnify and hold the City of Atlanta and its respective employees, contractors, agents, successors and assigns harmless from and against, and shall promptly reimburse them for, any and all losses, claims, damages, settlements, costs, and liabilities of any nature whatsoever (include reasonable attorneys’ fees) to which any of them may become subject arising out of, based upon, as a result of, or in any way connected with, your use of the Wi-Fi System or any breach of this Agreement.

You agree that the  City shall not be liable, and you hereby waive all claims against the City and hold the City harmless for, any damages arising from your use of the Service, including without limitation punitive, exemplary, incidental, special or consequential damages; damages related to loss of privacy or security; damages related to lost profits, loss of business, loss of data, or loss due to unauthorized access; damages related to loss due to viruses or other harmful components; personal injury damages; property damages; or any damages whatsoever. You further agree that the City shall not be liable, and you hereby waive all claims against the City and hold the City harmless for, any damages arising from any inability to use the Service or for interruption or failure of the Service. You further agree that the City shall not be responsible or liable for any cost of replacement products and services; the content of any data transmission, communication or message transmitted to or received by you; any goods or services purchased or messages or data received or transaction entered into through the Service.

 

No Warranty

THE WI-FI SYSTEM IS PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND. ATL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ATL MAKES NO EXPRESS WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OR TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSES REGARDING ANY MERCHANDISE, INFORMATION OR SERVICE PROVIDED THROUGH ATL OR THE INTERNET GENERALLY. YOU EXPRESSLY ACKNOWLEDGE THAT THERE ARE, AND ASSUME ALL RESPONSIBILITY RELATED TO, THE SECURITY, PRIVACY AND CONFIDENTIALITY RISKS INHERENT IN WIRELESS COMMUNICATIONS AND TECHNOLOGY AND ATL DOES NOT MAKE ANY ASSURANCES OR WARRANTIES RELATING TO SUCH RISKS. NO ADVICE OR INFORMATION GIVEN BY ATL OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY.

 

Entire Agreement, Applicable Law, Forum

This Agreement constitutes the entire agreement between you and ATL with respect to the subject matter hereof. This Agreement shall be construed under the laws of the State of Georgia without regard to its conflict of laws principles. The parties consent to the exclusive jurisdiction of the state courts of Fulton County, Georgia or of the United States District Court for the Northern District of Georgia and irrevocably agree that all actions or proceedings relating to this Agreement will be litigated in such courts. The parties waive any objection based upon improper venue or forum non conveniens.
